Terms of Use

1. Purpose and acceptance

These terms of use (the "Terms") govern access to and use of the ChessDate mobile application and its associated services (the "Service"), published by Eliott Vanlerberghe, a sole trader operating under the business name "ChessDate", registered with the Paris Trade and Companies Register under number 878 073 543, with its registered office at 173 rue de Courcelles, 75017 Paris, France, contactable at [email protected].

By creating an account, downloading or using the app, you agree to be bound by these Terms. If you do not agree with any of them, do not use the Service.

2. Description of the Service

ChessDate is a merit-based dating application built around the game of chess. It offers in particular:

• Creating a profile including photos, a biography and personality elements.
• Discovering other users and matchmaking interactions.
• Organising chess games with other users through a partner integration.
• Progressively unlocking a conversation after a game has been played.
• A Premium subscription offering extended features.

The Service may evolve. New features may be added, and some may be changed or removed.

3. Eligibility

To use ChessDate, you must:

• Be at least 18 years old. No exception is possible.
• Have the legal capacity to enter into a contract in your country of residence.
• Not have been previously banned from ChessDate.
• Have a valid Apple ID to create your account.
• Have or create an account on the partner chess platform to take full advantage of the Service. Connecting it enables chess level verification and unlocks the gameplay features.

Sign-up by a minor is strictly prohibited. Any false declaration of age results in immediate deletion of the account and may give rise to legal action.

4. Account creation and security

Sign-up is done through Sign in with Apple. You are solely responsible for keeping confidential the credentials associated with your Apple ID and your account on the partner chess platform. Any action taken from your account is deemed to have been taken by you.

The information you provide (first name, date of birth, photos, bio, and so on) must be accurate, up to date and about you personally. Profiles impersonating someone else, including photos that are not yours, or containing false information, are prohibited.

5. Code of conduct — Zero tolerance

ChessDate is a community where everyone deserves respect and safety. Objectionable content and abusive behaviour are not tolerated under any circumstances.

You agree not to post, share or transmit:

• Sexually explicit, pornographic or nude content (photos as well as messages).
• Hateful or discriminatory content, or content inciting violence on the basis of origin, gender identity, sexual orientation, religion, disability or any other characteristic.
• Violent, shocking or graphic content, or content promoting dangerous practices.
• Harassment, intimidation, cyberbullying, threats, or statements intended to humiliate others.
• Spam, unsolicited advertising, affiliate links or commercial solicitations.
• Content involving or directed at minors, or suggesting the presence of a minor.
• Fraudulent content, romance scams, requests for money, or offers of paid encounters.
• Content infringing the intellectual property rights of third parties, or disclosing someone else's private information without their consent.
• Personal information allowing someone to be contacted outside the app (phone number, address, and so on) without their explicit agreement.

You also agree not to engage in the following behaviour:

• Creating multiple accounts, including to circumvent a report, a block or a ban.
• Using automated means (bots, scripts) to interact with the Service.
• Attempting to cheat at chess (use of an analysis engine, external assistance, and so on).
• Attempting to circumvent the technical protections or security rules of the Service.
• Collecting, scraping or archiving other users' data.

6. Reporting and moderation

The app provides tools to report any content or behaviour contrary to these Terms. You can report a user at any time from their profile or from the associated conversation, and delete a match to end the conversation. An advanced blocking feature is available and will continue to evolve to strengthen your control over your interactions.

Our team handles reports as quickly as possible, and within 72 business hours of receipt at the latest. Depending on severity, the measures taken may include:

• Removal of the reported content.
• A warning issued to the author.
• Temporary suspension of the account.
• Permanent ban and deletion of the account.

Moderation is carried out after publication, on the basis of the reports received. We do not operate systematic automated pre-moderation of published content, but we reserve the right to review and remove any content contrary to these Terms at any time, without notice.

7. User content and licence

You retain full rights over the content you post (photos, bio, messages, answers to questions, and so on). By making it available to the Service, you grant us a non-exclusive, worldwide, royalty-free and revocable licence to host, store, reproduce and display that content to other users, solely to the extent necessary for the Service to operate.

This licence ends when you delete the content in question or your account, subject to cases where retention is required by law (ongoing reports, judicial requests, and so on).

You warrant that you hold all necessary rights over the content you post, and that it does not infringe the rights of third parties.

8. Premium subscription

ChessDate offers a Premium subscription giving access to extended features. The characteristics, durations and prices of the subscriptions are presented in the app before any purchase.

Payment method

Purchases are processed through Apple's in-app purchase system (App Store). Payment is charged to your Apple account upon confirmation. Technical processing is delegated to RevenueCat.

Automatic renewal

Subscriptions renew automatically at the end of each period unless turned off at least 24 hours before the end of the current period. The price applied is the one displayed at the time of renewal.

Management and cancellation

You can manage your subscription, change the payment method or turn off automatic renewal at any time from: iOS Settings > your name > Subscriptions. You can also reach it from the Profile screen in the app.

Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied on an intangible medium where performance has begun with your express agreement and your express waiver of that right, which is the case as soon as the subscription is activated.

Refunds

Refund requests are handled by Apple under its own terms. You can submit a request at reportaproblem.apple.com.

9. Availability of the Service

We take reasonable steps to keep the Service available, without guaranteeing absolute continuity. Interruptions may occur for maintenance, technical evolution, or force majeure.

10. Intellectual property

The ChessDate name, the logo, the interface, the graphic elements, the texts, the illustrations and any other element of the Service are protected by intellectual property law and remain the exclusive property of Eliott Vanlerberghe (sole trader, Paris Trade and Companies Register 878 073 543) or of his partners. Any unauthorised reproduction or use is prohibited.

11. Suspension and termination

You can delete your account at any time from the Profile screen in the app. The procedure starts immediately and cannot be cancelled. The privacy policy sets out what is erased and which items remain, in particular the messages already sent to your former matches. Deleting your account does not cancel your Premium subscription, which must be cancelled separately in iOS Settings.

We reserve the right to suspend or delete your account, without notice or refund, in the event of:

• Breach of these Terms, in particular the Code of conduct.
• Behaviour compromising the safety of other users.
• False declaration, in particular as to age or identity.
• Attempted fraud, circumvention of the rules, or harm to the Service.
• Use of the Service for unlawful purposes.

In the event of suspension or deletion for misconduct, the current Premium subscription is not refunded and any sums paid remain due.

12. Limitation of liability

ChessDate is a matchmaking service. We have no control over interactions that take place outside the app. You are solely responsible for your choices, your exchanges, and the meetings you decide to initiate.

We urge you to exercise the greatest caution when making contact or meeting in person: favour public places, tell someone close to you, and never share sensitive information with a user you do not know.

Scope of our liability

To the extent permitted by French law, we cannot be held liable for:

• Indirect damage (loss of opportunity, damage to reputation, emotional harm connected to a meeting, and so on).
• The acts, statements or behaviour of another user of the Service, whether on or off the app.
• Technical interruptions, malfunctions or data loss caused by the third-party services the app depends on (Apple, Google, RevenueCat, partner platforms, hosting providers).
• Force majeure within the meaning of Article 1218 of the French Civil Code.

Liability cap

To the fullest extent permitted by law, and except in the cases set out below, our total liability to you for any harm connected to the use of the Service, on any grounds whatsoever, is capped at the higher of the following two amounts:

• The total of the sums you have actually paid us for the Premium subscription during the twelve (12) months preceding the triggering event;
• One hundred (100) euros.

Statutory exceptions

Under French law, this cap does not apply:

• In the event of wilful misconduct or gross negligence on our part (Article 1231-3 of the French Civil Code).
• In the event of personal injury caused by us.
• In the event of a breach of an essential obligation depriving the contract of its substance (Article 1170 of the French Civil Code).
• For the rights that the law grants consumers on a mandatory basis, in particular under the French Consumer Code.

13. Changes to the Terms

We may amend these Terms to reflect changes in the Service or in legislation. The date of the last update appears at the top of the page. Substantial changes will be notified to you in the app. Continuing to use the Service after notification constitutes acceptance of the new version.

14. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, we invite you to contact us first at [email protected] so that we can seek an amicable solution.

Consumer mediation

In accordance with Article L612-1 of the French Consumer Code, in the event of an unresolved dispute you have a free right of recourse to a consumer mediator. The competent mediator appointed by ChessDate will be communicated in an update to these terms before the paid public launch of the app, and in any event on simple request to [email protected].

The European Online Dispute Resolution (ODR) platform was permanently closed on 20 July 2025 by Regulation (EU) 2024/3228. You can now consult the list of national alternative dispute resolution bodies on the European Commission website at consumer-redress.ec.europa.eu/dispute-resolution-bodies.

Jurisdiction

Failing an amicable agreement, and subject to any provisions more favourable to consumers, the French courts shall have sole jurisdiction.
